HandyGuy – Service Provider Advertising Platform

1. Introduction
Welcome to HandyGuy (“the Platform”, “we”, “us”, “our”).
HandyGuy is an online advertising and directory platform that allows service providers to advertise their services and allows customers to discover service providers.
By accessing, registering, advertising, or submitting a listing on HandyGuy, you agree to be bound by these Terms and Conditions, our Privacy Policy, and all applicable South African laws.
If you do not agree with these Terms, you may not use this Platform.
2. Nature of the Platform (Important)
HandyGuy is strictly an advertising platform.
- We do not provide services
- We do not employ service providers
- We do not act as agents, contractors, brokers, or guarantors
- We do not manage payments between users
- We do not enter into contracts on behalf of users
Any agreement, work, payment, or dispute is strictly between the service provider and the customer.
3. Service Provider Listings & Verification
To protect users and reduce fraud, HandyGuy may request verification documents including, but not limited to:
- CIPC registration documents
- Copy of ID or Driver’s Licence / Passport
- Customer reference letters
- Recent invoices or proof of business activity
Submission of documents:
- Is voluntary but required for verified or premium listings
- Does not guarantee approval
- Does not constitute endorsement by HandyGuy
Verification only confirms that documents were submitted — it does not guarantee quality, legality, pricing, or performance of any service provider.
4. User Responsibilities
Service Providers agree to:
- Provide accurate and truthful information
- Comply with all applicable laws and regulations
- Fulfil services professionally and legally
- Handle payments, contracts, disputes, and taxes independently
Customers agree to:
- Conduct their own due diligence
- Enter agreements at their own risk
- Resolve disputes directly with service providers
5. Payments & Non-Payment
HandyGuy does not process or hold payments between customers and service providers unless explicitly stated.
We are not responsible for:
- Non-payment
- Late payment
- Payment disputes
- Refunds
- Pricing disagreements
6. Advertising Packages & Fees
All advertising fees:
- Are for listing visibility only
- Are non-refundable, unless required by law
- Do not guarantee work, leads, income, or results
7. Limitation of Liability
To the fullest extent permitted by South African law, HandyGuy shall not be liable for any:
- Loss of income or profits
- Business interruption
- Reputation damage
- Service disputes
- Property damage
- Personal injury
- Fraud, misrepresentation, or negligence by users
8. Indemnity Clause (Very Important)
You agree to indemnify, defend, and hold harmless HandyGuy, its owners, directors, employees, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from:
- Disputes between service providers and customers
- Non-payment or late payment
- Poor workmanship or service quality
- Breach of contract
- Fraud, misrepresentation, or negligence
- Injury, loss, or damage suffered by either party
This indemnity applies whether the claim arises directly or indirectly from the use of the Platform.
9. No Warranties
All listings and services are provided “as is” and “as available”.
HandyGuy makes no warranties regarding:
- Accuracy of listings
- Availability of service providers
- Quality of services
- Reliability or legality of users
10. POPIA & Personal Information
Personal information is collected and processed in accordance with the Protection of Personal Information Act (POPIA) and our Privacy Policy.
Information is used solely for:
- Platform operation
- Verification purposes
- Fraud prevention
- Legal compliance
11. Termination
We reserve the right to:
- Remove listings
- Suspend or terminate accounts
- Reject or revoke verification
At our sole discretion, without prior notice, if these Terms are violated.
12. Governing Law
These Terms are governed by the laws of the Republic of South Africa.
Any disputes shall be subject to the exclusive jurisdiction of South African courts.
